Calling offshore online gambling "unregulated" can be inaccurate. Some businesses are regulated in one overseas jurisdiction yet are not allowed to supply an online casino service to an Australian customer. The gap is often between the state able to license a company, the country where the consumer is located and the authority able to resolve a particular dispute.
Three separate jurisdictions
First is corporate incorporation, which determines who the contracting entity is. Second is the licence territory and the category of gambling authorised. Third is the country of service delivery, where a separate prohibition may apply. In a dispute, the payment intermediary can add a fourth authority with different rules. None of these layers should be collapsed into the generic statement "regulated overseas".
Enforcement is real but imperfect
ACMA can investigate and request blocking of illegal gambling and affiliate websites. Its April–June 2026 compliance report recorded 30 investigations into 76 sites, 56 breaches and 187 referrals for blocking. These figures describe agency activity, not the proportion of every gambling website that is unlawful or the likelihood of recovering an individual's funds.
Limits of an audit badge
A technical certificate may test game randomness or a nominated software version. It does not necessarily establish legal permission to offer that game to Australians or create an Australian refund scheme.
